These Terms of Use set forth the terms and conditions for the provision of the Service and the relationship of rights and obligations between the Company and users. Users of the Service are required to read and agree to the Terms and Conditions in their entirety before using the Service.



Article 1. Definitions

1. "Service" means all services provided by "MinRally", a service provided by Fantrec Inc. (hereinafter referred to as “the Company").

2. "Rally" means a project to visit points located on a map using the Service.

3. "User" means a person who agrees to these Terms of Use and participates in a rally organized by a "Rally Master" using the Service.

4. "Checkpoint" means a location designated by Rally Master, including buildings, stores, etc., whose information is registered in the rally.

5. "Rally Master" is a person who organizes the rally and can register and provide information on checkpoints, special offers, and other information. This "Rally Master" includes all businesses in general, including our company.

6. "User" means users and Rally Master collectively. However, the Company is not included herein.



Article 2. Agreement to Terms of Use

1. The purpose of these Terms of Use is to define the terms and conditions of the Service and the rights and obligations of the Company and the User with respect to the use of the Service, and shall apply to all actions and legal relationships when the User uses the Service.

2. User shall use the Service in accordance with these Terms of Use.

3. By using the Service, the User is deemed to have agreed to all of the terms and conditions of this Agreement.



Article 3. Application and Scope of Terms and Conditions

1. Rules regarding the use of the Service posted on the Company's website, etc. shall constitute a part of these Terms of Use.

2. In the event that the Terms of Use of a checkpoint are inconsistent with these Terms of Use, these Terms of Use shall take precedence.

3. In the event of any inconsistency between the Terms of Use and any other information regarding the Service, the Terms of Use shall take priority.



Article 4. Modification of Terms and Conditions

1. The Company may change the contents of the Terms of Use at any time and for any reason.

2. Whenever the Company changes the Terms of Use, it will do so by setting the effective date of the change and displaying a notice on the Service stating that the Terms of Use have been changed and the content of the changed Terms of Use.

3. If a user uses the Service after a change in the Terms of Use takes effect, the user is deemed to have agreed to all changes in the Terms of Use.



Article 5. Contents of the Service provided to the User

1. The content of the Service provided by the Company to the User shall be as follows:

(1) Registration for the Service

(2) Change and deletion of registration information

(3) Viewing of rally information on the ServiceP

(4) Viewing of checkpoint information on the Service and check-in at those checkpoints

(5) Posting comments and reviews on the rally

(6) Obtaining and using the points and rewards available at the rally and at each checkpoint

(7) Sending messages to Rally Master

(8) Following Rally Master

(9) Sharing rally information with other users

(10) Other services related to (1) through (9) above.

2. The Company may, at its sole discretion, change the Service or terminate all or part of the Service at any time. Users shall agree to such changes in advance.



Article 6. Contents of the Service provided to Rally Master

1. The content of the Services to be provided by the Company to Rally Master shall be as follows:

(1) Application for registration with Rally Master

(2) Modification or deletion of registration information

(3) Creation of rally

(4) Change/deletion of rally information

(5) Transfer of rally administrator

(6) Setting of rewards for users who participate in rallies

(7) Other services related to (1) through (6) above.

The Company may, at its sole discretion, change the Service or terminate all or part of the Service. Rally Master shall agree to such changes in advance.



Article 7. Use of the Service by Users

1. Users may register or apply to use the Service by agreeing to abide by the Terms of Use and providing the Company with certain information in a manner prescribed by the Company.

2. Upon completion of the registration procedure, a Service Usage Contract will be established between the User and the Company, and the User will be able to use the Service. The User may use the Service by submitting the prescribed application for the Service.

3. Users shall use the Service at their own risk.

4. Users shall promptly notify the Company of any changes in the information they have provided in the manner prescribed by the Company.

5. In any of the following cases, the user may not be able to use the Service, and the Company may refuse the use of the Service. In addition, the Company shall not be obligated to disclose any reason for denial of service.

(1) When there is a falsehood, error, or omission in all or part of the required information provided by the user to the Company.

(2) When it is found that the user has received a temporary suspension of use, permanent suspension, cancellation of registration, or termination of contract in the past.

(3) In the event that the User is found to be in violation of the prohibition of use by antisocial forces.

(4) In any other case in which the Company deems it inappropriate for the User to use the Service.

6. Users may use the service in the manner explained on the Service.

7. Any requests, inquiries, or claims by the User regarding the use of the Privileges or any other rally shall be made directly to Rally Master by the User.

8. Even if Rally Master cancels, changes, or deletes a rally provided on the Service, Rally Master shall not be liable for any damage, and the User shall not claim compensation from Rally Master for any damage, which shall be settled at Rally Master's responsibility.



Article 8. Ownership of Rights, etc.

1. All intellectual property rights and other rights related to the Service and the Company's website belong to the Company or those who have granted licenses to the Company. The Service is established by granting non-exclusive, non-transferable, and non-licensable rights of use to the user. The granting of these rights of use does not transfer these intellectual property rights or any other rights from the Company to the user.

2. Users shall represent and warrant to the Company that they have legal rights and that they are not infringing upon the rights of any third party when using the Service.



Article 9. Prohibitions

In using the Service, Users shall not engage in any of the following acts:

1. Any act in violation of laws, court judgments, decisions, etc., or any act related to criminal acts.

2. Use or attempt to use the Service for purposes or in a manner that may cause damage to the Company or a third party.

3. Acts that infringe or may infringe intellectual property rights, portrait rights, rights of privacy, honor, or other rights and interests protected by law or contract of the Company or a third party.

4. Acts of using the Service or information on the Service for any purpose other than the purpose of using the Service for oneself or a third party.

5. Acts of registering or posting false information on the Service, or acts of using the Service by impersonating a third party.

6. Any actions that interfere with the system or are intended to cause a malfunction of the Service, including the transmission or posting of information that contains harmful computer programs or places an excessive load on the Service.

7. Intentional use of malfunctions in the Service.

8. Other acts that are or may be against laws, regulations, and public order and morals.

9. Other acts that we deem inappropriate.

Article 10. Confidentiality

Users shall not disclose or divulge to any third party, without the prior written consent of the Company, any non-public information that the Company has expressly indicated it will treat confidentially in relation to the Service, except when legally required to disclose such information.

The Service may run advertisements or promotions from third parties on or in connection with the Service, or may provide information on third party products or services or links to such information. However, any transactions, terms, etc. arising therefrom shall be between the user and the third party. We are not involved in any way in such transactions or advertising. Therefore, we are not responsible for any loss or damage resulting from such transactions, advertisements, or promotions.



Article 12. Services Provided by Third Parties

The Service may contain links to services and websites other than the Service. However, when users access these third-party websites, etc., they do so at their own risk. The Company assumes no responsibility for the content or functionality of these third-party websites, or for their accuracy or legality. In addition, the Company shall not be liable for any loss or damage incurred by the user through these third-party websites.



Article 13. Handling of Personal Information

1. The Company shall appropriately handle personal information ("personal information" as defined in the Act on the Protection of Personal Information) obtained from users when providing the Service in accordance with the Company's Privacy Policy, which is separately stipulated. Users agree to the handling of their personal information by the Company in accordance with this Privacy Policy.

2. When a user registers to use the Service, the Company may inquire the user's personal information such as name, address, telephone number, and e-mail address.

3. The Company shall not be liable for any loss or damage to Rally Master or checkpoint, or to users, other users, or third parties, due to the loss or destruction of such information through no fault of the Company in the handling of personal information.



Article 14. Measures against Violations, etc.

1. If the Company determines that a User falls under any of the following, the Company may, without prior notice or demand, temporarily or permanently suspend the use of the Service by such User, erase the User's registration information, terminate the Service Agreement, or take any other measures that the Company deems necessary:

(1) When any of the provisions of Article 9. are found to be violated.

(2) When the Company is unable to contact the User.

(3) In any other case in which the Company deems it inappropriate for the User to continue using the Service.

2. The Company shall not be liable for any damages incurred by the user as a result of actions taken by the Company in accordance with this Article.



Article 15. Primary and Permanent Suspension of the Service

When deemed necessary by the Company, the Company may temporarily or permanently suspend part or all of the Service without prior notice to the User. In such cases, the Company shall not be liable for any damages incurred by the user. Even after the termination of the contract, all terms and conditions of this agreement that are intended to persist shall continue.



Article 16. Disclaimer

1. The company shall not be liable for any information provided on the service (including the service itself, information provided by e-mails, etc. sent in connection with the service, links to websites managed and operated by third parties displayed on the service, and any information contained on these websites), including user information, including the accuracy and appropriateness of any information provided on the service. In addition, the Company shall not be liable for any damages incurred by the user in connection with the use of such information.

2. Except in the case of willful misconduct or gross negligence on the part of the Company, the Company shall not be liable to the user for any disadvantages incurred by the user as a result of a malfunction of the Service or the effect on the user's smartphone or PC equipment, or the user's inability to use the Service properly, or for any other disadvantages incurred by the user in connection with the use of the Service. Even in the event that the Company is liable, the Company shall not be liable to compensate for damages to the user as described in this paragraph beyond the amount of compensation paid directly to the Company by the user during the past year, nor shall the Company be liable for incidental damages, indirect damages, special damages, future damages, or damages for lost profits.

3. In no event shall we be liable for any disputes, troubles, illegal acts, etc. arising between users or between users and checkpoint when using this service, and users shall be responsible for resolving such disputes, troubles, etc. at their own responsibility.



Article 17. Upgrading of the Service

1. The Company may develop and provide an upgraded version of the Service, or provide upgraded information and support services to the User at any time if the Company deems it necessary.

2. The Company shall not be obligated to develop or provide an upgraded version of the Service or to provide support for the Service to the User.

3. The Company shall not be liable to the User for any of the following events:

(1) When this service is changed, suspended, discontinued, or abolished.

(2) In the event of unauthorized access to data, computer viruses, or other unauthorized acts, despite the Company's reasonable security measures, resulting in damage to the user.

(3) When damage is caused by the contents of services such as information, points, or benefits that Rally Master or checkpoint voluntarily provides through the use of this service, or its revision or abolishment.



Article 18. Transfer

1. The User may not transfer his/her rights, obligations, or contractual status regarding the Service to other Users or third parties without the prior written consent of the Company or the fulfillment of conditions set in the system.

2. In the event that the Company transfers all or part of the Service to a third party (including business transfers, corporate divestitures, and any other cases in which business is transferred), the Company may transfer the contractual status, rights and obligations under the Terms and Conditions, the user's registration items, and other customer information to the transferee of such transfer. The user agrees in advance to such transfer.

3. In the event that the Company transfers all or part of the Service to a third party, the Company shall notify the user by posting on its website or by any other method the Company deems appropriate.



Article 19. Compensation for Damages

If the user causes damage to our company, other users, or third parties as a result of violating these terms of use or using this service, the user shall compensate for said damage at the user's own responsibility and expense.

In the event that we receive a claim, demand, or prosecution of any kind from a third party as a result of the user's use of the service, the user shall respond to such claim, demand, or prosecution at the user's own responsibility and expense.



Article 20. Prohibition of Use by Antisocial Forces

1. The user shall represent that he/she does not fall under any of the following items on the date of commencement of use of the service, and shall make a firm promise that he/she will not fall under any of the following items in the future:

(1) Bouryokudan (organized crime groups)

(2) Bouryokudan member

(3) A person who has not been a Boryokudan member for a period of "5" years.

(4) Quasi-organized crime syndicate members

(5) Companies affiliated with organized crime groups

(6) General meeting house

(7) Goro, a person who is a target of social activities, etc.

(8) Special Intelligence Groups

(9) Other persons equivalent to each of the preceding items.

2. When a user is a corporation or an organization, the user represents that he/she does not fall under any of the following items on the date of commencement of use of this service, and shall make a firm promise that he/she will not fall under any of the following items in the future:

(1) Controlled by antisocial forces

(2) Antisocial forces are substantially involved in the management of the Company

(3) Unjustly utilizing antisocial forces for the purpose of gaining unjust profits for oneself or a third party, or for the purpose of inflicting damage on a third party, etc.

(4) Involvement in antisocial forces by, for example, providing funds, etc. or benefits to antisocial forces

(5) The user's own officers or those substantially involved in the management of the user's company have a relationship with antisocial forces that should be socially evacuated.

3. The user shall make a firm promise to the Company and other users that he/she will not commit any of the following acts by himself/herself or by using a third party:

(1) Violent acts of demand

(2) Unreasonable demands beyond legal responsibility

(3) Acts of threatening words or deeds, or acts of violence

(4) Acts of spreading rumors, using deception or force to damage the credibility of the Company or other users, or to obstruct their business

(5) Other acts equivalent to the preceding items.

4. If it is found that a user has made a false declaration in relation to the representations in this article or has violated the commitments in this article, we may immediately suspend the user's use of the service without prior notice or demand.

5. The user shall be liable for compensation for any damages incurred by the Company in the event of suspension of use based on Paragraph 4.

6. The Company shall not be liable for any damages incurred by the user in the event of suspension of use based on Paragraph 4.



Article 21. Governing Law

The laws of Japan shall apply to the formation, validity, performance, and interpretation of these Terms and Conditions.



Article 22. Jurisdiction

In the event of any disputes arising out of or in connection with these Terms and Conditions, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.



Article 23. Complete Agreement

These terms and conditions constitute the entire agreement between the user and the Company regarding the use of the service and replace all prior agreements and understandings, whether written or oral, regarding the subject matter of these terms.
